These Terms and Conditions are a legal contract between you (either an individual or a single business entity) and Community Loan Center Corporation, a Texas corporation ("CLC"), for the use and operation of technology and software for the online origination and servicing of loans made in connection with the Affordable Small Dollar Loans Program, which includes computer software and, as applicable, associated media, printed materials, and "online" or electronic documentation (collectively, the "Service"). BY CLICKING THE ICON BELOW, OR BY REGISTERING FOR USE OF THE SERVICE, OR BY INSTALLING, COPYING, OR OTHERWISE USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING THE WARRANTY DISCLAIMERS, LIMITATIONS OF LIABILITY AND TERMINATION PROVISIONS BELOW. IF YOU DO NOT AGREE TO SUCH TERMS AND CONDITIONS, DO NOT USE THIS APPLICATION OR THE SERVICES AND EXIT NOW. Access to and use of this site and its contents are permitted for online origination and servicing of, and/or access to the online portal for the application for and management of, loans made in connection with the Affordable Small Dollar Loans Program, which means services in connection with CLC�s program by which participating entities provide small dollar loans to individuals, and such individuals apply for and manage such loans. Any other access to or use of this site or its contents is unauthorized. Important and private information should be protected by you. We are not liable for protection of privacy of electronic mail or other information transferred through the Internet or any other network provider that you may use. We maintain and control ownership of all IP numbers and addresses that may be assigned to you. We reserve, in our sole discretion, the right to change or remove any and all IP numbers and addresses. By registering, you certify that the information you provide on the registration form is accurate and pertains only to you. You are responsible for maintaining the confidentiality of the password you are assigned. Your password may not be shared with any other person. Your agreement to be bound by these Terms and Conditions (this "Agreement") is effective upon your acceptance of such Terms and Conditions as set forth herein and shall remain in full force and effect until terminated. You may terminate this Agreement for any reason upon 30 days notice to CLC. We reserve the right, in our sole discretion and without notice, to terminate this Agreement or to deactivate or suspend your use of the Service under reasonable circumstances. You agree not to (1) take any action that imposes an unreasonable load on the site�s infrastructure, (2) use any device, software or routine to interfere or attempt to interfere with the proper working of the site or any activity being conducted on the site, (3) attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or making up the site, (4) delete or alter any material posted by any other person or entity, or (5) frame or link to any of the materials or information available from the site. Information and materials posted by CLC are provided for general reference only and are not warranted to be free of errors, other deficiencies or potential interruptions. In addition, the site may be used by others to post other information and materials, including changes or additions. Information and materials posted by others is considered non-confidential. In no event should the availability of such information and materials be construed as an indication they have been validated by CLC or represent the views of CLC, CLC does not monitor all submissions to the site, but reserves the right to do so and to remove or edit material that is in violation of these terms of use or other policies of CLC. If you submit any information to our site, you agree not to (1) post or transmit anything that is defamatory, abusive, libelous, unlawful, obscene, threatening, harassing, fraudulent, pornographic, or harmful, or that could encourage criminal or unethical behavior, (2) post or transmit pyramid schemes or chain letters or conduct gambling, (3) post or transmit anything that violates the copyright or intellectual property rights of any person or entity, (4) post or transmit a virus or any other harmful component, or (5) contact other site users through unsolicited e-mail, telephone calls, mailings or any other method of communication. When retrieving information from our site, you are prohibited from (1) using or attempting to use spiders, robots, avatars, intelligent agents, or any other extraction or navigation search except for a normal browser, (2) aggregating, copying or duplicating any of the materials or information available from the site except for the small amount of materials and information temporarily required for an ordinary single use of the site, or (3) accessing data not intended for such user. Should you decide to submit, enter or transmit through use of the Service, information or materials of any kind, you are responsible for ensuring that you may do so and that such information and materials may be accessed, used, copied, distributed and adapted by other users of the Service (including CLC or its host providers). You are authorized to access, use and copy information and materials available through the Service only for purposes of the Affordable Small Dollar Loans Program. The information and materials, including pages and content, may not be copied, distributed, modified, published, or transmitted in any other manner, including for use for creative work or to sell or promote other products. Violation of this policy may result in infringement of intellectual property and contractual rights of CLC or third parties which is prohibited by law. THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. USE OF THE SERVICE IS AT YOUR SOLE RISK. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE, NOR DO WE MAKE ANY WARRANTY AS TO ANY RESULTS THAT MAY BE OBTAINED BY USE OF THE SERVICE. WE MAKE NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IN RELATION TO THE SERVICE. UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES FOR ANY MATTER ARISING FROM OR RELATING TO THIS AGREEMENT, THE SERVICE OR THE INTERNET GENERALLY, INCLUDING, WITHOUT LIMITATION, YOUR USE OR INABILITY TO USE THE SERVICE, ANY CHANGES TO OR INACCESSIBILITY OF THE SERVICE, DELAY, FAILURE UNAUTHORIZED ACCESS TO OR ALTERATION OF ANY TRANSMISSION OR DATA, ANY MATERIAL OR DATA SENT OR RECEIVED OR NOT SENT OR RECEIVED, ANY TRANSACTION OR AGREEMENT ENTERED INTO THROUGH THE SERVICE, OR ANY DATA OR MATERIAL FROM A THIRD PERSON ACCESSED ON OR THROUGH THE SERVICE, WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT OR OTHERWISE. YOUR SOLE AND EXCLUSIVE REMEDY SHALL BE TO DISCONTINUE USE OF THE SERVICE AND TERMINATE THIS AGREEMENT IN ACCORDANCE WITH THE TERMS HEREOF. You agree to indemnify, hold harmless and defend us, our shareholders, directors, officers, employees and agents from and against any action, cause, claim, damage, debt, demand or liability, including reasonable costs and attorneys� fees, asserted by any third person arising out of or relating to (i) this Agreement, (ii) your use of the Service and (iii) any unacceptable use of the Service. We have the right, at any time and without notice, to amend, add or modify the Terms and Conditions by delivering such amended, added or modified Terms and Conditions by email to the address provided to us by you. Your use of the Service after the date such amended, added or modified Terms and Conditions are delivered to you shall be deemed to constitute your acceptance of the same. These terms shall be governed by and construed and enforced in accordance with the laws of the State of Texas, excluding its laws relating to conflicts of laws.

ESIGN CONSENT TO USE ELECTRONIC RECORDS AND SIGNATURES As part of your relationship with us, we want to ensure you have all of the information you need to effectively manage your accounts. Our goal is to provide you with as many options as possible for receiving your account documents. We are required by law to give you certain information "in writing" – which means you are entitled to receive it on paper. We may provide this information to you electronically, instead, with your prior consent. We also need your general consent to use electronic records and signatures in our relationship with you. So, before you use our Electronic Services (as defined below) you must review and consent to the terms outlined below. In this ESIGN consent: • "We," "us," "our" and "CLC" means the Community Loan Center of the Rio Grande Valley and each and every current and future affiliate of the Community Loan Center of the Rio Grande Valley. • "You" and "your" means the person giving this EISGN consent, and also each additional account owner, co-signer, authorized signer, authorized representative, and/or service user identified on any CLC product that you apply for, use or access. • "Communications" means each disclosure, notice, agreement, fee schedule, statement, record, document, and other information we provide to you, or that you sign or submit or agree to at our request. • "Electronic Service" means each and every product and service we offer that you apply for, use, administer or access using the Internet, a website, email, messaging services (including text messaging) and/or software applications (including applications for mobile or hand-held devices), either now or in the future. • "CLC Product" means each and every loan, account, product or service we offer that you apply for, own, use, administer or access, either now or in the future. CLC Products include Electronic Services. • The words "include" and "including," when used at the beginning of a list of one or more items, indicates that the list contains examples – the list is not exclusive or exhaustive, and the items in the list are only illustrations. They are not the only possible items that could appear in the list. 1. CONSENT TO ELECTRONIC DELIVERY By selecting the "I AGREE" button, you specifically agree to receive and/or obtain any and all CLC -related "Electronic Communications" as defined herein in electronic form. You specifically consent to receive electronic mail (email) and online communications and disclosures regarding your account instead of by regular mail. Except as noted below or otherwise at our discretion, communications will not be furnished on paper. Your consent will apply to all information we send to you, or disclose or communicate to you online, relating to your account, including monthly billing statements, and any disclosures that are required by law to be in writing, including, without limitation, Truth In Lending Act disclosures and tax forms. The term "Electronic Communications" includes, but is not limited to, any and all current and future notices and/or disclosures that various federal and/or state laws or regulations require that we provide to you relating to any documents you sign, as well as such other documents, statements, data, records and any other communications regarding your relationship with CLC. If you change your email address, you agree to call us at (956) 356-6600 and update your email address. You accept Electronic Communications as reasonable and proper notice for the purpose of any and all laws, rules, and regulations, and agree that such electronic form fully satisfies any requirement that such communications be provided to you in writing or in a form that you may keep. 2. YOUR CONSENT COVERS ALL CLC PRODUCTS; PRIVACY POLICIES Your consent covers all Communications relating to any CLC Product. Your consent remains in effect until you give us notice that you are withdrawing it. From time to time, you may seek to obtain a new CLC Product from us. When you do, we may remind you that you have already given us your consent to use Electronic Records and signatures. If you decide not to use Electronic Records and signatures in connection with the new product or service, your decision does not mean you have withdrawn this consent for any other CLC Product. You agree that we may satisfy our obligation to provide you with an annual copy of our Privacy Policy by keeping it available for review on [insert website address for Privacy Policy] or, with prior notice to you, on another website where we offer Electronic Services. 3. ELECTRONIC SIGNATURE AGREEMENT By selecting the "I AGREE" button, you acknowledge that you have read, understand and agree to the following: • You are voluntarily choosing to sign your CLC documents electronically; • You understand that the documents we present on this website will replace the use of paper documents; • You understand and agree that your electronic signature will bind you to the terms and conditions to the same extent as if you signed your CLC documents on paper with an ink signature; • You understand and agree that no certification authority or other third party verification is necessary to validate your E-Signature and that the lack of such certification or third party verification will not in any way affect the enforceability of your E-Signature or any resulting contract between you and any CLC entity; and • You understand that you have the right to withhold your consent to the use of electronic documents and signatures, and that you have the right to withdraw your consent at any time prior to completing the ESIGN process. Please be aware, however, that withdrawal of consent may result in the termination of your access to use Electronic Services. 4. PAPER VERSION OF ELECTRONIC COMMUNICATIONS You may request a paper version of an Electronic Communication. You acknowledge that CLC reserves the right to charge you a reasonable fee for the production and mailing of paper versions of Electronic Communications, unless charging a fee is prohibited by applicable law. To request a paper copy of an Electronic Communication, please contact us at (956) 356-6600. 5. REVOCATION OF ELECTRONIC DELIVERY You have the right to withdraw your consent to receive/obtain Electronic Communications at any time. Please be aware, however, that withdrawal of consent may result in the termination of your access to our Electronic Services and your ability to use certain CLC products. Your withdrawal of consent will become effective after we have had a reasonable opportunity to act upon it. To withdraw your consent, you must contact us at (956) 356-6600. 6. VALID AND CURRENT EMAIL ADDRESS You agree to keep CLC informed of any changes in your email address. You may modify your email address by calling us at (956) 356-6600. 7. CONTROLLING AGREEMENT This Agreement supplements and modifies other agreements that you may have with any CLC entity. To the extent that this Agreement and another agreement contain conflicting provisions, the provisions in this agreement will take precedence (with the exception of provisions in another agreement for an electronic service which provisions specify the necessary hardware, software and operating system, in which such other provision controls). All other obligations of the parties remain subject to the terms and conditions of any other agreement. 8. HARDWARE, SOFTWARE AND OPERATING SYSTEM REQUIREMENTS To receive Electronic Communications, you must be able to view, print, and retain information presented on-screen. By selecting the "I AGREE" button, you confirm that you are able to view Hyper Text Markup Language (HTML) files and read PDF files. By selecting the "I Agree" button, you also confirm that you have an active email address, a connection to the Internet, a computer and an operating system capable of supporting all hardware and software requirements, and access to a current version of an Internet browser we support, including: • Google Chrome latest version • Mozilla Firefox latest version • Safari latest version and on Mac OS X 1.6+ • Internet Explorer version 11 or higher • Edge latest version 9. CHANGES TO HARDWARE OR SOFTWARE REQUIREMENTS If our hardware or software requirements change, and that change would create a material risk that you would not be able to access or retain your Electronic Records, we will give you notice of the revised hardware or software requirements. Continuing to use Electronic Services after receiving notice of the change is reaffirmation of your consent. 10. BY ACCEPTING THIS NOTICE, YOU CONFIRM TO US THAT: • You have the hardware and software described above; • You can access and read this Consent and Notice Regarding Electronic Communications and Electronic Signatures; • You have an active email; • You can print this disclosure on paper, or save the disclosure to a place where you can print it, for future reference and access; • You consent to use and sign electronically an electronic version of any CLC documents; • You are authorized to, and do consent on behalf of all the other account owners, authorized signers, authorized representatives and service users identified with your CLC products; and • You consent to the terms and conditions of this Agreement. *It is recommended that you print a copy of this Agreement for future reference.
